Order Before: EDWARDS, Chief Judge, ENGEL, Circuit Judge, and BROWN,* Chief District Judge. On receipt and consideration of an appeal in the above-styled case in which petitioner Fuller attacks his state court sentence of life imprisonment for the crime of first degree murder on eight separate counts; and Finding from an examination of the state court record that there is no merit to his claim of a coerced confession or that his conviction was based upon evidence seized in an unlawful search and seizure; and Noting further that as to all other grounds urged before the District Court there had been a failure to exhaust remedies, as outlined in the opinion and orders of District Judge Don Young, dated June 29, 1978 and July 24, 1978, Now, therefore, for the reasons set forth above and in the District Judge's orders cited, the judgment of the District Court is affirmed.
